Article 38(1)(b) of the statute of the International Court of Justice 1945 classifies customary international law as a source of international law; and defines it as a ‘general practice accepted by law’. It is based on two factors. Webshould be linkages or overlap between customary international law and the customary law of indigenous peoples and local communities, but in general these two distinct areas of law and practice should not be confused with one another. Customary law is, by definition, intrinsic to the life and custom of indigenous peoples and local communities.
